This privacy policy (“Privacy Policy”) outlines how Edge Networks, Inc. (“Edge”, “we”, “our”, “us”) and its affiliates collect, use and share information about Evoca Subscribers and others who visit Edge websites (www.evoca.tv), use the Evoca Service, or view and interact with any other content, applications, features, functionality, information and services offered by Edge (collectively, “Services”). The term “you” refers to you as a subscriber or user of our Services. This Privacy Policy will remain in full force and effect, even if your use of or participation in the Services or any particular service, feature, function or promotional activity offered through the Services terminates, expires, ceases, is suspended or deactivated for any reason. If you do not agree with this Privacy Policy, please do not participate in the Services or any features, activities or services offered through the Services.

This Privacy Policy governs only the information (i) collected by us from you and/or (ii) provided to us by a third party platform (a “Third Party Platform”) about you, in each instance, on or in connection with your use of the Services and does not cover any other information collected in any other manner or collected by any other entity, unless specifically stated. We may combine your Information (as defined herein) with other information we collect from other sources, such as information you have provided to third parties, including, but not limited to, our affiliated companies, marketing companies or advertisers and have provided sufficient consent, and, if we do so, our use of the resulting combined Information will be subject to this Privacy Policy.

Personal Information. “Personal Information” means any information that we collect on or in connection with the Services that would allow someone to identify you or contact you, such as your full name, service address, billing address, e-mail address or telephone number.

Additional Information. “Additional Information” means any information that we collect on or in connection with the Services other than Personal Information, such as usage data and logs, content viewed, video on demand usage, DVR activity, etc. We may also collect and keep other information such as billing and payment history, customer service interactions, and equipment and programming options.

Our Services include features that automatically collect certain Additional Information such as Internet protocol (IP) address, location data, and other Information regarding your use of the Services to assist us in authenticating your usage and/or Scout device, keeping track of your preferences, creating a more tailored user experience, etc.

The Services and/or third parties may use “cookies”, “embedded scripts”, and other similar tracking technologies to collect Additional Information automatically as you interact with the Services. We may associate this information obtained with your Personal Information so we can better customize your experience using the Services and provide tailored advertisements, recommendations and other content related to your specific interests or profile.

We may also receive Information about you or your household from third parties such as third party advertising networks, business partners, consumer reporting agencies, data exchanges, traffic measurement service providers, marketing analytics services providers and other third parties (“Third Party Services”). This Information may, for example, allow us to serve advertisements on the Services, facilitate targeting of advertisements and/or measure and analyze advertising effectiveness and/or traffic on or in connection with the Services. (Personal Information and Additional Information is, collectively, “Information”).

We may use your Personal Information for the following purposes:
- Providing any services or products that you request or purchase in connection with the Services, including billing and collections;
- Contacting you regarding the administration of any features or functions of the Services you have registered to use;
- Sending you marketing and promotional e-mails;
- Responding to your questions or other requests;
- Tailoring your experience on the Services and/or otherwise customizing what you see when you use the Services;
- Saving your registration and profile data or other Personal Information (so you do not have to re-enter it each time you visit or use the Services); and
- For other purposes disclosed at the time you provide us with the Personal Information or which are reasonably necessary to provide the Services or other related product and/or service requested.

We may use the Additional Information for the following purposes:
- Tracking your return visits to and use of the Services;
- For research purposes, for marketing/promotional purposes and/or to provide anonymous reporting for internal and external clients, business partners, etc.;
- Accumulating and reporting aggregate, statistical information in connection with the Services and user activity;
- Determining which features and services users like best to improve the Services, enhance and improve display advertising and marketing information;
- Providing targeted advertising;
- Saving certain Additional Information for your ongoing use of the Services;
- For the uses described for “Personal Information” above; and
- For other purposes disclosed at the time you provide us with the Additional Information or which are reasonably necessary to provide the Services or other related product and/or service requested.

At times, you may be presented with the option to receive, or be automatically entered to receive, certain marketing and promotional communications from us and others that we think will be of interest to you. Recipients of such communications can unsubscribe by following the specific instructions included in such communications. Please note that “opt-out” and “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your Information shall remain subject to the prior privacy settings. Additionally, you should be aware that any Information provided to third parties prior to your election to opt out or unsubscribe cannot be retrieved or rescinded by us unless required by applicable law, and you cannot retroactively opt out or unsubscribe with respect to such third parties. Also, please note that in order to keep you informed about the operation of our Services, we may always send you emails and announcements that are needed for the proper functioning and administration of our Services, in connection with your use of such Services. We may also have features that allow you to submit information, questions or feedback to us. In those instances, we may retain your emails and other information you submit to us for our internal purposes, and to help us to serve you better.

Generally, we do not sell, rent, lease or disclose your Personal Information to third parties, except if you consent to such disclosure or as otherwise described in this Privacy Policy. We reserve the right to use and/or sell any aggregated, anonymized data we collect in connection with your access to and/or use of the Services. We may disclose Personal Information to our affiliated companies for marketing and/or administrative purposes. You can choose to opt-out of certain such uses as described in Section 4 above.

The Services may offer co-branded services and features, such as events and promotions provided by us and/or our affiliated companies or other third party partners, and that may be hosted on the Services and/or our co-branded partner’s website, platform or service. We may share your Personal Information with such co-branded partners. The co-branded partner will be identified on the co-branded feature or service, along with the co-branded partner’s privacy policy. If you wish to opt-out of a co-branded partner’s future use of your Personal Information for marketing or other purposes, you will need to contact the co-branded partner directly. The use of such information by co-branded partner is subject to co-branded partner’s privacy policy.

We also have the right to disclose your Personal Information and other information to third parties, or permit third parties to collect such information, for the purpose of administering and maintaining the Services (“Third Party Service Providers”). We use Third Party Service Providers to efficiently provide the full range of content, activities, services, features and functions we bring you and we disclose your Information to Third Party Service Providers for the purpose of providing services to us and our affiliates. These Third Party Service Providers may temporarily store certain Information on their servers, but they may only use your Personal Information to provide Edge with a specific service and not for any other purpose.

Other than as set forth in this Privacy Policy, we do not share your Personal Information with other third parties, apart from those acting as our agents in providing our Services to you, and which agree to use it only for that purpose and to keep the information secure and confidential. Also, please be aware that our affiliated companies, including all their respective business units, subsidiaries, affiliates and sites, entities into which our companies may be merged, or entities to which any of our assets, products, sites or operations may be transferred, may obtain from us and be able to use your Personal Information.

There may be instances when we may access or disclose Information without providing you a choice in the following circumstances: (i) to protect or defend the legal rights or property of Edge, our affiliated companies or their employees, agents and contractors (including enforcement of our agreements); (ii) to protect the safety and security of our Services and users; (iii) protect against fraud or for risk management purposes; (iv) if we believe your actions violate the Terms and Conditions; or (v) to comply with law or legal process. In addition, if Edge sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, we may transfer your Information to the party or parties involved in the transaction as part of that transaction who may use that Information for the purposes set forth in this Privacy Policy.

We do not knowingly collect personal information from children under 13 without appropriate parental notice and consent. Please visit www.consumer.ftc.gov for information from the Federal Trade Commission about protecting children’s privacy online.

We maintain commercially reasonable physical, electronic and procedural safeguards to protect your Personal Information. However, regardless of our efforts, it is possible that third parties may unlawfully intercept or access transmissions or private communications over an unsecured transmission. We also limit access to the Services by our own employees, contractors, Third Party Service Providers and those individuals who are authorized for the proper handling of such information. We request that our third party contractors and Third Party Service Providers follow similar standards of security and confidentiality.

The Services may be linked to, rely on and or be integrated with websites, applications, interfaces, services and/or platforms operated by other companies, including Third Party Services and Third Party Platforms. The Services may also feature advertisements from other third parties. Edge is not responsible for the privacy practices of such websites, applications, interfaces, services and platforms operated by third parties that are linked to, rely on and/or integrated with the Services or for the privacy practices of third party advertising companies.

Comments. When visitors leave comments on the site, we collect the data shown in the comments form, and the visitor’s IP address and browser user agent string to help spam detection.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Cookies. If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
Embedded content from other websites. Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
Email Collection. Evoca will never send you spam or share your personal information. Evoca will only use your email to notify you about updates to our service.

We may modify this Privacy Policy at any time. Your continued use of the Services after we post a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes. We will notify you of any material changes through written, electronic, or other means as permitted by law.
